Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Rekov ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Rekov is an iOS application that analyzes biometric data from Apple HealthKit and optional third-party wearable platforms (Strava, WHOOP, Fitbit, Garmin, Polar, Wahoo, Oura) to provide recovery scores, training load analysis, sleep insights, and workout recommendations.

3. Health Disclaimer

You should:

• Always consult a qualified healthcare professional before making changes to your exercise routine, especially if you have a pre-existing condition
• Not rely solely on Rekov's recommendations for health decisions
• Seek immediate medical attention if you experience chest pain, dizziness, or other concerning symptoms during exercise
• Understand that biometric data from consumer wearables has inherent measurement limitations and may not always be accurate

4. Eligibility

You must be at least 13 years old to use Rekov. If you are under 18, you must have parental or guardian consent.

5. User Accounts

Creating an account is optional. Rekov works fully offline without an account. If you create an account:

• You are responsible for maintaining the security of your login credentials
• You agree to provide accurate information
• You must notify us promptly if you suspect unauthorized access to your account
• We reserve the right to suspend or terminate accounts that violate these Terms

6. Subscriptions & Payments

6.1 Free Tier

Rekov's core features (recovery scoring, sleep analysis, training load, workout tracking, wearable integrations) are available for free.

6.2 Rekov Pro

Advanced features are available through a paid subscription ("Rekov Pro"), managed entirely through Apple's App Store and StoreKit. By subscribing:

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage or cancel subscriptions in your Apple ID Account Settings
• Refunds are handled by Apple in accordance with their refund policies

6.3 Free Trial

If a free trial is offered, it will convert to a paid subscription at the end of the trial period unless cancelled beforehand. Unused portions of a free trial are forfeited upon purchasing a subscription.

7. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' data
• Interfere with the proper functioning of the App
• Use automated systems to access the App in a manner that sends more requests than a human could reasonably produce
• Redistribute, sublicense, or resell the App or any part of it

8. Third-Party Integrations

Rekov integrates with third-party platforms (Strava, WHOOP, Fitbit, Garmin, Polar, Wahoo, Oura). These integrations are subject to each platform's own terms of service and privacy policies. We are not responsible for the availability, accuracy, or policies of third-party services.

You authorize Rekov to access and retrieve your data from these platforms when you connect them. You can revoke this access at any time from Settings.

9. Intellectual Property

The App, including its design, code, algorithms, branding, and content, is owned by Rekov and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Your data belongs to you. We claim no ownership over your health data, recovery scores, or any content you create within the App. You can export your data at any time using the Data Export feature.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• Rekov is provided "as is" and "as available" without warranties of any kind, express or implied
• We do not warrant that the App will be uninterrupted, error-free, or that defects will be corrected
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
• Our total liability for any claim arising from these Terms or use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim
• We are not liable for decisions you make based on data or recommendations provided by the App

11. Indemnification

You agree to indemnify and hold harmless Rekov, its developers, and affiliates from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Modifications to the App & Terms

We reserve the right to modify, suspend, or discontinue any part of the App at any time. We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms. Material changes will be communicated through the App or via email.

13. Termination

You may stop using the App at any time by deleting it from your device. We may terminate or suspend your access if you violate these Terms. Upon termination, your local data remains on your device. Cloud data may be deleted after account termination in accordance with our Privacy Policy.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of the State in which Rekov's principal place of business is located.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
